Grooveshark Back In, Then Quickly Out of the Google Play Store

Grooveshark, an online music streaming service, faces another setback as its application is once again removed from the Google Play store, less than a week after being approved for sale. This mirrors the company?s experiences from more than a year ago, when the Grooveshark app was first released and then removed from the Google?s application marketplace.

Unlike music streaming services such as Spotify and Rdio, Grooveshark allows users to listen to online music stations, build playlists and play an unlimited number of songs for free. These features have angered the music industry, lead to numerous lawsuits as well as pressure against any businesses deemed to support the music sharing website.

After its initial removal from the Google Play store (then called the Android Market), Grooveshark worked with Google directly to remove any objectionable content from its application. Once these concerns were address, the application was allowed back into the Google Play store, only to be removed again a week later. No word from Google or Grooveshark on what caused this new problem.?

Grooveshark fans who still want a Grooveshark app can download it directly from Grooveshark?s mobile website. A large number of app downloads, however, originate from Google Play, so this app removal will definitely hamper Grooveshark adoption.

Neil Armstrong's family, NASA remember first moonwalker

The late astronaut Neil Armstrong, first man on the moon, was memorialized in ceremonies around the country on Friday (Aug. 31).

Armstrong, 82, passed away Aug. 25 due to complications resulting from cardiovascular surgery, which he underwent earlier this month.

In July 1969, Armstrong commanded Apollo 11, the first manned lunar landing mission. His first words upon setting foot on the moon were, "That's one small step for (a) man, one giant leap for mankind."

Armstrong's family, together with invited guests including the first moonwalker's fellow astronauts and the leadership of NASA, gathered at the Camargo Club in Cincinnati for a private memorial service on Friday morning.

The family's service was strictly invitation-only and closed to the press. The guest list was not released, but among those in attendance were Armstrong's two Apollo 11 crew mates Buzz Aldrin and Michael Collins, as well as Apollo astronauts Bill Anders, Dick Gordon, Jim Lovell and Gene Cernan. Mercury astronaut and former Ohio Senator John Glenn also attended with his wife Annie.

Senator Rob Portman (R-OH) eulogized Armstrong, as did the astronaut's two sons Eric ("Rick") and Mark, and Piper Van Wagenen, one of Armstrong's 10 grandchildren.

"Today, we pay tribute to a pioneering American; an explorer, a patriot and an individual who, with 'one small step,' achieved an impossible dream. Family, friends and colleagues of Neil's gathered to reflect on his extraordinary life and career, and offer thanks for the many blessings he shared with us along the way," said NASA Administrator Charles Bolden in a statement. U.S. Navy F/A-18 jets flew overhead in a "Missing Man" formation at the end of the service in honor of Armstrong's service as a naval aviator.

National remembrances

According to NASA, planning is underway for a national service to be held Sept. 12 in Washington, D.C., although no other details have been released.

In the meantime, two NASA centers held public tributes on Friday.

The U.S. Space & Rocket Center, the visitor center for NASA's Marshall Space Flight Center in Huntsville, Ala., hosted a ceremony around its 363-foot tall Saturn V rocket display, launching red, white and blue balloons in memory of Armstrong. Present were astronauts Owen Garriott, Jan Davis and Fred Leslie.

The Kennedy Space Center in Florida also met around its moon rocket exhibit at the Apollo/Saturn V Center, where center director Robert Cabana led the remembrance.

President Barack Obama ordered flags be flown at half mast on the day Armstrong is interred, although when that will occur and where the late moonwalker will be laid to rest is not yet public.

Wink at the (blue) moon

Earlier this week, the Armstrong Air and Space Museum in the astronaut's hometown of Wapakoneta, Ohio held a public tribute, where attendees gathered to "wink at the moon," a gesture first suggested by Armstrong's family.

"For those who may ask what they can do to honor Neil, we have a simple request. Honor his example of service, accomplishment and modesty, and the next time you walk outside on a clear night and see the moon smiling down at you, think of Neil Armstrong and give him a wink," the family said in a statement.

In a coincidental bit of cosmic alignment, Friday is a "blue moon," or the second full moon of the month.

More tangible tributes are underway on television and in print.

The Discovery Channel is set to air "One Giant Leap: A Neil Armstrong Tribute," a new one-hour documentary, on Saturday at 8 p.m. EDT. The program includes footage from Armstrong's final public appearance and interviews with Apollo 11 crewmates Aldrin and Collins.

And Easton Press, which specializes in limited edition, leather-bound books, has partnered with LIFE magazine to publish a special 96 page photo retrospective. The book, "Neil Armstrong, 1930-2012," is set for release in October.

Armstrong's family has established the "Neil Armstrong New Frontiers Initiative," a memorial fund benefiting the Cincinnati Children's Hospital Medical Center. They have asked that in lieu of flowers, memorials be made to the Initiative, or to two scholarship funds setup in Armstrong's name by the Telluride Foundation and by the American Institute of Aeronautics and Astronautics (AIAA).

He seems genuine to me,' then think I will have done my job for me and if they say I like the vision he's laid out for the country and for his party for the next four years, then I will have done the job for my party and my country," he said.

Christie had a tip for Mitt Romney when he takes the stage Thursday: open up to the American people.

"I've always said this George?Mitt Romney is going to have to win this campaign. And to do that over the next 70 days he's going to have to let the American people see who he is, put out a bold vision for the future. Remember, he's a challenger?Challengers always get a late look," he said.

Over the weekend Mitt Romney repeated the famous Popeye quote "I am who I am" in several interviews, implying that perhaps he wouldn't show more of his personal side this week.

Christie disagrees, and credits Rep. Paul Ryan for already bringing out a new side of the presidential candidate.

"I think you've seen [Romney] show a lot more of himself even since Paul Ryan has joined the ticket. I think Paul has brought energy to the ticket and he's brought great energy to Governor Romney after a long and arduous campaign. So I think that the American people are going to see a lot more of him and they're going to start seeing it tonight with Mrs. Romney," he said. "Who no one can speak better or more articulately about the man that Mitt Romney is and the leader he'd be for our country than Ann Romney so I think the fun starts tonight, George, and I think the American people are going to start to get a complete picture about who Mitt Romney is and why he'd be a great president."

With Samsung win on Galaxy Tab, judge may reconsider U.S. ban

(Reuters) - Apple Inc's legal victory on Friday over Korean rival Samsung Electronics Co Ltd was crushing but for one key front in its global smartphone and tablet patent war: Samsung's Galaxy Tab 10.1.

The jury in the San Jose, California, federal court awarded the iPhone and iPad maker $1.05 billion in damages and said Samsung had copied critical features in the U.S. company's products.

However, it declined to side with Apple on one patent, covering design elements on the iPad. That put the jury directly at odds with the judge in the case who, only two months earlier, had sided with Apple over allegations the Galaxy Tab 10.1 tablet ripped off Apple's design.

U.S. District Judge Lucy Koh issued a pre-trial order barring Samsung from selling the Galaxy Tab 10.1 in the United States.

Late on Sunday, Samsung asked Koh to dissolve the order, due to the jury's finding. "There is thus no proper basis for maintaining the injunction," Samsung attorneys wrote.

An Apple representative could not be reached immediately for comment.

Samsung's Galaxy touch screen tablets, powered by Google's Android operating system, are considered by some industry experts to be the main rival among larger tablets to the iPad, although they are currently a distant second in sales to Apple's device.

Normally, when a preliminary injunction based on one patent becomes inconsistent with a subsequent verdict, the party subject to the injunction asks the court to lift it, said Mark McKenna, a professor at the University of Notre Dame's Law School.

Yet while the jury absolved Samsung on allegations the Galaxy Tab violated Apple's design patent, it did say the device infringed some of Apple's software patents. That could complicate Samsung's pitch, McKenna said.

"If Samsung or Google could design around those patents, use features that didn't infringe, then they could sell the devices without violating the injunction," McKenna said.

Additionally, Koh can overrule the jury's decision and issue a verdict saying the Galaxy Tab infringed Apple's design patent.

"Judge Koh appears to be of the mindset that the accused Samsung tablet easily meets the 'substantially the same' infringement standard - so much so that the facts lead to one and only one conclusion - infringement," said Christopher Carani, a partner at Chicago-based intellectual property law firm McAndrews, Held & Malloy.

"Thus, Apple has a greater chance than usual to succeed in convincing Judge Koh to play this extraordinary trump card."

If the sales ban is ultimately dissolved, Samsung could go after Apple for damages for the wrongful imposition of the injunction, legal experts said.

Samsung, which has various tablet line-ups with different sizes from 7 inches to 10.1 inches, introduced the Galaxy Tab 10.1 in June last year and recently unveiled an upgraded version, the Galaxy Tab 10.1 II.

The company said that Koh's injunction would not affect the updated Tab 10.1 II.

The case in U.S. District Court, Northern District of California, is Apple Inc v. Samsung Electronics Co Ltd et al, 11-1846.

Standing up to cancer: Don't let the beat go on

I sat down in an examining room with shaking knees, a sober-faced doctor and biopsy results. The news was not good.

There are moments that change your life forever. This was one of them. I was diagnosed with cervical cancer, a mother of two in my 30s. I?ll never feel invulnerable again.

I?d missed a yearly Pap smear, but I was young and, I thought, healthy. I made the mistake of putting myself last, as women too often do; taking care of everyone else?s needs but neglecting to tend my own.

Regret is wasteful and useless and empty; it deters action and voids hope. But that was all I could feel at first, knowing a simple screening could have changed my life.

If only, if only, if only.?.?. the chorus drummed in my head over and over again, an anchoring beat for the chirping fears and incessant what-ifs that flew through my head like scattered birdsong. I wondered if I would get to see my babies grow up, reach for unfulfilled dreams, or live to see 40.

Cervical cancer is the second most common cancer among women worldwide. It?s also incredibly preventable: Ninety-two percent of women diagnosed with cervical cancer will survive if it?s found early. The Centers for Disease Control and Prevention recommend an annual Pap smear once women turn 21, or within three years of becoming sexually active.

Yet, cervical cancer screenings across the United States are declining more than any other preventive health measure for women: All but three states reported a drop in the number of women receiving Pap smears in 2010, according to the National Women?s Law Center.

And, despite its preventability, one-third of the 12,000 U.S. women diagnosed with cervical cancer in 2008 died from this disease, says the CDC. Had I waited even one more year for a screening, I would have been one of them.

Too many women are still skipping screenings, often because they?re financially strapped. It?s no coincidence that cervical cancer occurs more frequently in women who are poor or without health insurance.

That?s a sobering thought when we think of Mitt Romney?s intent to cut federal funding for both Planned Parenthood and Title X reproductive health services if he?s elected president this fall.

There?s a four-letter word nicely suited to that problem: v-o-t-e. We have an opportunity in November to vote against any state or national politician who would deliberately put women in harm?s way for the sake of ideology.

Because while the cost of healthcare is often high, the cost of neglecting a Pap test is higher. Even for those who survive, there?s still an awful lot to lose.

Irregular pre-cancerous cells are easily removed. Once cancer develops, however, a common treatment is to cut off part of the cervix, putting future pregnancies at risk. I traded a piece of my cervix for a chance at survival. It was painful and I was scared, but they cut out all the cancer.

It was then that I met cancer?s sinister shadow. You can get cancer ? and it can come back. I was paroled, but not free: Without a hysterectomy, there was a 20 percent chance the cancer would return. I hadn?t yet closed the door on more children, but cancer slammed it shut.

I had to choose between having more children and living to see the children I have grow up. Put that way, it?s an easy decision. But the truth is there?s nothing easy about cancer. No woman should have to lose her life, or her fertility, to such a preventable disease.

We can help all women by fighting to retain funding for screenings, and exercising our right to vote. We can help ourselves by honoring that fight, getting checked regularly, and encouraging our loved ones to do the same.

If only, if only, if only.?.?. don?t let the beat go on.

Jantjies boosts troubled Currie Cup champs Lions

Elton Jantjies kicked a late penalty to give Currie Cup title holders Golden Lions a 26-23 win over Western Province Saturday and a happy end to another depressing week.

Regular match-winner Jantjies bagged 21 points from seven penalties and his only place-kick miss was the conversion of a Joshua Strauss try while rival fly-half Demetri Catrakilis claimed 13 points for the visitors from Cape Town.

A judge this week ordered the financially troubled Johannesburg-based rugby franchise to pay junior Super 15 partners Pumas and Leopards $655,000 (525,000 euro) in outstanding fees.

This blow came a week after the Lions were axed from the 2013 southern hemisphere provincial championship to make way for Southern Kings -- a demotion that could cost the perennial battlers $6 million (4,795 million euro).

But the financial woes and relegation were temporarily forgotten at sparsely populated Ellis Park as the Lions won for the second time in three Currie Cup outings this season.

Alzheimer's drug fails study but flashes potential

(AP) ? An Alzheimer's treatment from Eli Lilly and Co. failed to slow memory decline in two separate patient studies, but the drug did show some potential to help in mild cases of the mind-robbing condition that is notoriously difficult to treat.

The Indianapolis drugmaker's announcement could be a step toward a long-awaited breakthrough in the fight against the disease. But researchers not tied to the studies ? and Eli Lilly itself ? cautioned against overreacting to the initial results.

Lilly said Friday that its treatment, solanezumab, failed to slow the rate of cognitive decline, which involves a person's ability to remember things, in two late-stage studies of about 1,000 patients each. But when data from the trials were combined, scientists saw a statistically significant slowing of that rate in the bigger population.

They also saw a statistically significant result when they examined a subgroup of patients with mild cases of Alzheimer's disease. The studies focused on patients with mild to moderate Alzheimer's cases.

Lilly officials would not discuss details of the results and said that they plan to talk with regulators about the next steps for the drug, which has yet to receive Food and Drug Administration approval. Full results from the studies will be presented at two scientific conferences in October. It's unclear how the FDA will view the results, given that the drug missed its main goals.

William H Thies, chief medical and scientific officer for the Alzheimer's Association, which was not involved in Lilly's research, said the statistical significance of the combined results is important.

"If that can be replicated, that is a major finding," he said. "It's the first time we've been able to change the course of Alzheimer's disease or any part of Alzheimer's disease in people."

But because the drug missed its main goals, Thies said the drug "isn't going to the (FDA) tomorrow to be approved for sale."

If you look through "rose-colored glasses" at the results, there may be a sign of potential benefit on cognitive tests, said Dr. Ronald Petersen, director of the Mayo Clinic's Alzheimer's Disease Research Center. But it is not clear whether that is enough to make a real difference clinically in how patients do, he said.

The key will be details the company will present later on brain imaging and other tests, he said.

"The danger would be an over-interpretation of a small finding or a subtle effect," said Petersen, who heads a safety monitoring panel for two companies working on a different Alzheimer's treatment.

About 35 million people worldwide have dementia, a term for brain disorders that affect memory, judgment and other mental functions. Alzheimer's is the most common type. In the United States, more than 5 million people have Alzheimer's, which is the country's sixth-leading cause of death.

Many Alzheimer's patients typically live four to eight years after diagnosis, as the disease gradually erodes their memory and ability to think or perform simple tasks. Current Alzheimer's treatments only temporarily ease symptoms such as memory loss, confusion and agitation. They don't slow, stop or reverse mental decline.

Drugmakers have tried and failed for years to develop successful treatments for the disease, and patients and doctors are anxious for something that can slow the disease's progression. Analysts have said such a treatment, if approved, could be worth billions of dollars in sales.

Earlier this month, Pfizer Inc. and Johnson & Johnson said they would end development of an intravenous version of their potential Alzheimer's treatment, bapineuzumab, after two late-stage studies showed it worked no better than a placebo in patients with mild-to-moderate cases. The companies are still studying an injectable version of the drug.

Lilly's announcement Friday comes two years after the drugmaker stopped developing another potential treatment, semagacestat, after patients taking the drug wound up faring worse than those on a placebo.

Scientists say the search for a better Alzheimer's treatment presents several problems. To start, the brain is the most complex organ in the body and the one that researchers know the least about.

Biological triggers behind disease development remain largely unproven, although certain factors like age increase the risk of getting it. Scientists believe changes in the brain of a person with Alzheimer's begin several years before the patient shows symptoms of the disease. That means that by the time diagnosis happens, the brain may be essentially too damaged for potential treatments to work.

Doctors diagnosed John Baker, 71, of Watertown, S.D., with early-stage Alzheimer's disease in 2010. The former mechanical engineer said his family has watched him become forgetful, tell the same stories over and over and misplace things. He said he has no expectation that scientists will make a breakthrough soon enough to help him.

"Realistically, I'm not going to wait and worry and read every line on every report," he said.

Still, he's taking Aricept, a treatment for the disease made by Pfizer and Japanese company Esai Co. Ltd, to try to control the symptoms. He's also participating in a brain scan study to help doctors find a cure for future generations.

Lilly officials cautioned Friday that their study did not show that solanezumab slowed the progression of Alzheimer's. Even so, they were encouraged.

Solanezumab binds to beta-amyloid protein, which scientists believe is a key component to sticky plaque that basically gums up the brain of a patient with Alzheimer's disease. The drug is designed to bind to the protein and help the body remove it from the brain before it can form that plaque. Lilly said that while the individual trials missed their main goals, the combined results showed there may be some validity to this approach.

"We really think this idea of attacking amyloid plaques is a valid hypothesis, that's important news," said Dave Ricks, president of Lilly Bio-Medicines.

But Dr. Sam Gandy, head of Alzheimer's disease research at Mount Sinai School of Medicine in New York, said Lilly's statement on the results "is very tentative."

"I believe in the notion that an amyloid-lowering agent like solanezumab will eventually work in early disease or pre-symptomatically, but whether these data provide compelling evidence that solanezumab has 'cleared the bar' just cannot be concluded" until full results are presented, Gandy wrote in an email.

Dr. Tim Anderson, an analyst who covers Lilly for Bernstein Research, said in a research note the solanezumab results would be viewed positively because expectations for the drug were low.

Lilly is counting on drugs in its development pipeline to help replace revenue it is losing due to patent expirations for key products. The company lost U.S. patent protection for its all-time best-selling drug, the antipsychotic Zyprexa, last year, and it will lose protection for its current top-seller, the antidepressant Cymbalta, next year. Those drugs totaled $8.78 billion in revenue last year, or 36 percent of the company's total.

Lilly shares climbed 3.4 percent, or $1.46, to $43.86 Friday, outpacing broader trading indexes that rose less than 1 percent.

So, it seems that all those airborne clues about LG's new superphone are slowly coalescing into something more concrete. In fact, according to the folk at AndroidMx, so concrete they've actually had a go with one. Most of the specification they report chimes with what we'd already heard. The 1.5GHz quad-core Snapdragon S4, the 2GB of RAM, the 4.7-inch IPS display, Android 4.0.4 and 13-megapixel camera, all present and correct. The screen resolution actually claims to be 1,280 x 768 if the grabs are to be believed, but AndroidMx does remind us that this is all pre-production hardware, so final details might change. This makes sense, especially given the video tease we saw yesterday, which hinted at a slightly more rounded design. Hopes are, that we'll be put out of our misery come IFA, but with other potentially big announcements also in the pipeline, it's going to be a busy week in mobile-land.

But that wasn't nearly the entire story of the Dots' 48-34 victory at O.O. White Stadium, a game in which they dodged all manner of Wildcats threats before scoring 21 unanswered points in the final 18-plus minutes.

The biggest came in the fourth quarter with the game tied at 34, a play that threw injury to the insult that is Nitro's 16-game losing streak.

Ethan Clark, who riddled the Dots with 156 receiving yards and 79 rushing yards and three touchdowns, was well on his way to a fourth. He took a punt at his own 39-yard line, lost a few defenders, cut back and nothing but green grass and his own teammates in front of him.

Then, at the 5-yard line, he fell suddenly. On this warm night, he cramped at the worst possible time. Even worse, his teammates couldn't bail him out. Not even Alexander White, whose attempt at his third field goal was smothered by Poca's Tyler Gibson.

One play later, after the Dots committed an illegal formation foul, T.T. Loudin reeled off a 74-yard run. That play didn't provide the go-ahead score, but it was the beginning of Nitro's end.

It was a tough way for Derek Midkiff to begin his Nitro coaching career.

"He's been hurt the last couple of weeks, really hasn't practiced," Midkiff said of Clark. "He was out there giving his all like the rest of us was. Nothing you can do about a muscle; when it wants to cramp, it will cramp."

For much of the game, the Dots pulverized the Wildcats on the ground, producing three runners well past 100 yards rushing. Loudin had 210 on 22 carries, quarterback Jake Payne had 134 on 18 attempts and Levi Clendenin added 143 on 11 tries. Payne and Loudin each scored three times.

Loudin, a junior, is the man who has to pick up the slack for 1,000-yard rusher Dalton Hedrick, who did not come out for football this fall.

"He's going to be a good running back," said Poca coach Bob Lemley. "He had a sports [hernia] or some kind of injury, he couldn't play last year. So he lost that experience as a sophomore.''

The Dots went for the kill early, as Clendenin picked off Christopher Moody's first pass and walked in from the 4 for the opening score. After White kicked a 31-yard field goal for Nitro, Loudin scored from the 8 to make it 12-3.

For much of the game, the Dots pulverized the Wildcats on the ground, producing three runners well past 100 yards rushing. Loudin had 210 on 22 carries, quarterback Jake Payne had 134 on 18 attempts and Levi Clendenin added 143 on 11 tries. Payne and Loudin each scored three times.

Loudin, a junior, is the man who has to pick up the slack for 1,000-yard rusher Dalton Hedrick, who did not come out for football this fall.

"He's going to be a good running back," said Poca coach Bob Lemley. "He had a sports [hernia] or some kind of injury, he couldn't play last year. So he lost that experience as a sophomore.''

The Dots went for the kill early, as Clendenin picked off Christopher Moody's first pass and walked in from the 4 for the opening score. After White kicked a 31-yard field goal for Nitro, Loudin scored from the 8 to make it 12-3.

Clark and the Dots served quick notice that victory wasn't going to come so easily. The 5-foot-11, 175-pound senior hit the corner quickly on an end around, going untouched on a 66-yard TD run. The Wildcats had a great chance to take the lead after forcing the second of Poca's three lost fumbles.

The Wildcats drove from their 48 to the Poca 1, where Brayden Underwood scored an apparent touchdown on a hard-fought 1-yard run. But the officials flagged Nitro for illegally assisting Underwood on the score, a 5-yard penalty Midkiff disputed.

On fourth-and-goal from the 2, Underwood was stonewalled by Brandon Pryor, Hayden Bailey, Gibson and other Dots.

After that, the Dots drive 99 yards, all on the ground, to take a 19-10 lead. White's 32-yard field goal gave set the halftime score at 19-13.

To start the second half, Moody completed one of three touchdown passes, ducking a rush to throw a 36-yard shot to Steven Erlewine. That gave Nitro its first lead at 20-19, but the Dots answered with a 49-yard drive (assisted by an ill-advised late hit) to retake the lead at 27-20.

The Moody-to-Clark combination, which clicked 10 times, gave Nitro a 34-27 lead with scoring plays of 8 and 38 yards. Clark was particularly impressive on the former, bowling over a defender at the 5-yard line.

The Dots tied it with 1:10 left in the third on another run-only drive, with Payne scoring from the 1. Early in the fourth quarter, Poca's defense dodged another bullet on a bad shotgun snap from its 9. Bailey outfought two Wildcats for that fumble.

Then came the fateful punt and Clark's fateful return that wasn't. After that turn of events, Payne scored on an 8-yard run with 4:42 left, crushed Moody on an 11-yard sack and handed off to Loudin for a game-icing 6-yard run with 1:27 remaining.

Lemley has seen his team give up a few punt returns in his 23 years on the Poca sideline, but he hasn't seen such misfortune as that suffered by Clark.

"We'll just put that in our playbook," Lemley joked, sympathetically. "I don't want to do that too many times."

News: Google-Apple "Patent" War Heats Up (Again)

Search giant seeks to have Apple's entire US lineup hit with a banstick

Ever since Apple recognized that Google's Android mobile OS was a threat to the dominance of the iPhone, it has sought to use the courts to stymie competition. With bans in various countries of the Galaxy Tab and Samsung Galaxy as well as many HTC and Apple devices this litigiousness has reached fairly epic proportions for the consumer. We're now seeing what is probably Google's largest ever legal salvo fired at Apple in response.

This salvo is a direct result of Google's having acquired Motorola's cellphone division in May of this year. This was a move designed largely to bolster its arsenal of patents with which to fight Apple and protect partners that use its Android mobile OS such as HTC, Samsung and LG. Fresh from announcing the culling of a fifth of Motorola's employees and a third of its locations, Google submitted a 50 page document? to the International Trade Commission (ITC) which seeks bans on Apple importing to the US, its entire current lines of computers, notebooks, iPads and iPhones:

"[Google] seeks a permanent exclusion specifically related to [Apple] excluding from entry into the United States certain wireless communications devices, portable music and data processing devices, computers, and components thereof" -?Submission Excerpt

While this document is entirely serious in tone, it is essentially a case of Google following a strategy of?'the best defense is offense" in legal terms. It's unlikely that the submission will result in Apple stores with completely empty shelves, rather Atomic would expect to see any successes in court used as leverage to bring Apple to the negotiating table internationally.

Many such submissions have been thrown out in the UK (with Apple being forced to print a 'Samsung didn't copy the iPad' apology in several British newspapers). However Apple won a significant victory a few days ago in Europe with the 7.7" Galaxy Tab being banned in the EU via German courts and similar attempts are ongoing in Australia. At present Apple also hold something of an advantage in America with several rulings in their favour and a $US2.7bn damages case against Samsung in deliberation; this is something Google clearly hopes to change.

Atomic will keep you informed of developments as both companies hand-slap each other all over the international courts; we simply don't expect sanity from either party anytime soon.
